Legal notice and B2B terms

3. Payment, delivery and risk

Unless trade credit has been approved in writing, payment must be received before dispatch. Delivery dates and route frequencies are estimates confirmed per order. Public holidays, volume, regulated goods, carrier disruption or force majeure may change timing.

The customer must inspect parcels, quantity and visible damage on delivery, record issues on the delivery note and report shortages or defects in packed goods within four days. Internal defects must be reported promptly and within the applicable commercial-law period. Nothing here limits rights that cannot legally be excluded.

4. Returns and credit

There is no automatic voluntary trade return. A return requires prior written authorisation and a reference number. Opened, used, incorrectly stored, personalised, customer-expired or hygiene-, safety- or regulation-restricted products cannot be accepted.

When Neptox approves a commercial return, the normal remedy is replacement, substitution or a credit note for future purchases. A cash refund is provided where required by law or expressly agreed in writing. Defective goods and shipping errors are handled separately and are not excluded by this policy.

5. Regulated products

The customer is responsible for licences, buyer age checks, storage, advertising and resale under destination-country rules. Neptox may refuse or cancel products where sale, transport or import is not lawful or verifiable. Nicotine, tobacco, vape and alcohol products are for adults and authorised trade customers only.

6. Privacy

We process name, company, email, telephone, country, interest and message to respond, prepare a quotation and manage the commercial relationship. The legal basis is the pre-contractual request and legitimate interest in handling trade enquiries. Forms are processed through Cloudflare and delivered to Neptox’s business account. We do not sell data or use it for marketing without a valid legal basis.

Enquiries without follow-up are kept only as reasonably necessary; order and invoicing documents are retained for statutory periods. You may request access, correction, deletion, restriction, objection or portability at [email protected]. You may also complain to the Spanish Data Protection Agency.

7. Cookies and technology

The website uses necessary local storage to remember market, basket and technical preferences. It currently places no advertising or tracking cookies. If consent-based analytics or advertising is introduced, a choice mechanism will be shown before activation.

8. Liability and governing law

Neptox remains liable as required by law for fraud, wilful misconduct, gross negligence and obligations that cannot be limited. In other B2B cases, direct liability is reasonably limited to the value of the affected order, excluding indirect loss or lost profit where the law permits. Spanish law applies. The parties will first try to resolve disputes in writing; trade disputes are submitted to the courts for Neptox’s registered place of business unless mandatory law requires otherwise.
